PANJIM: The High Court of Bombay at Goa has issued notice to Union Ministry for Environment and Forests (MoEF) in connection with a petition related to issuance of forest clearance for felling trees at Tiracol.

A division bench comprising Justice Anoop V Mohta and Justice Nutan Sardessai on February 27 issued notice on a petition filed by Salvador Rodrigues and Augustine Rodrigues challenging a forest clearance issued to Goa State Infrastructure Development Corporation (GSIDC) on December 30, 2015 for clearing the forest on survey Nos 14 and 15.

GSIDC has undertaken construction of a bridge to link Tiracol across the river Keri. The petitioners have prayed for cancellation of the forest clearance order, and in the interim, for stay of its operation.

The petitioners informed the court that though they are owners and in possession of Survey Nos 14 & 15 of Tiracol, and GSIDC without their knowledge and consent filed an application for diverting the forest on their plots under the provisions of the Forest Conservation Act.

The petitioners stated that despite the Conservator of Forests writing to GSIDC to produce proof of ownership of the land, MoEF had issued ‘in-principle’ clearance on December 30, 2015, for diverting the forest on the plot.

Further, GSIDC also paid an amount of Rs 3.6 lakh as the cost of forest clearance to the Ministry despite the fact that it did not own the land or the forest.
