Truly Your Honour, Goa’s greatest asset is its environment

No activist, no politician and yes no journalist has so evocatively struck a very deep, and increasingly hidden chord in the hearts of those Goans who still believe that this land is worth preserving and fighting for, as the bench of Justices Gautam Patel and Nutan Sardesai of the Bombay High Court did while delivering the judgment on the transfer of Goa’s cases in the National Green Tribunal from the Western Zone bench in Pune to the principal bench in Delhi.

No activist, no politician and yes no journalist has so evocatively struck a very deep, and increasingly hidden chord in the hearts of those Goans who still believe that this land is worth preserving and fighting for, as the bench of Justices Gautam Patel and Nutan Sardesai of the Bombay High Court did while delivering the judgment on  the transfer of Goa’s cases in the National Green Tribunal from the Western Zone bench in Pune to the principal bench in Delhi.

 The sheer emotion that was infused in the judgment took over the points of argument to deliver a far greater sermon for the greater good of the Goan people. As it quashed an MOEF Notification transferring all Goa cases in the NGT Pune to its principal bench in New Delhi, it raised the bar of the principles on which justice is delivered and in the end it was a testimonial to the innate belief of the Goan people that their land and environment is indeed priceless.

Their Court’s words appeared from a distant fading universe till they travelled to the reality of today to encourage our people to stop and simply look at what our assets are. “Its greatest asset is environment and its ecology, its rivers and riverbanks, its beaches, its lakes and clear streams, its dense forests, its low hills and fertile fields, its boulders and even trees shrouded with moss and vines and lichen in the rains, its ridiculously brilliant sunsets” (From the HC judgment).

This could have been a song writers words, or a poets evocation, or a description of a painting on canvas, the painter furiously panting his muse - Goa and its nature- with vivid brush strokes. But this was a judgment of a High Court where normally, the heart plays second fiddle to the cold reality of facts and evidence. But this was treated as a truly emotional piece of litigation and judged in the same manner.

The Court went into why Goans knock on the doors of the court. And here is what the bench said. “If the NGT in Pune has so very many cases from Goa, it is not because – or not just because – the people of Goa are litigious; if true, that may only speak to their continued faith in the legal system and its processes. It is because they perceive that there is something of value here to protect. Few are frivolous causes; in the past few weeks, we saw none.” 

The Bench also said, “This is a land truly worth fighting for”. But who are we fighting against? Against those forces who see environment and the protection of it as an impediment and weaken the institutions like the GCZMA, the Pollution Control Board and even the Environment department. When these institutions get strengthened, it also strengthens the government’s arms and muscles in a genuine fight- if it engages it self- against destroyers of environment.

The judgment encourages those with the will to fight against wrong doings to the land of Goa, to fight the good fight since according to the High Court bench of Justices Patel and Sardesai, “this is a land truly worth fighting for”.

Therefore from coal pollution, to coastal degradation to massive encroachments and hill cutting, to the plunder of forests and khazan lands to the destruction of sand dunes, each is a cause worth fighting for, because if this fight is stopped than the effect on Goa will be far more destructive and any one time calamity. And today, the last words will have to the ones of the High Court as it said “These are after all, struggles for a better tomorrow”.
