Petition challenges government letter putting in operation draft Outline Development Plan Calangute-Candolim 2025
PANJIM: The High Court of Bombay at Goa on Monday issued notices to North Goa Planning and Development Authority, Government of Goa and Candolim panchayat after hearing a Public Interest Litigation filed by Candolim residents challenging the Calangute-Candolim ODP 2025.
Dimiao Teles and 10 other residents of Candolim have challenged the letter of the government putting in operation the draft Outline Development Plan Calangute-Candolim 2025 of December 16, 2016. The petitioners contended that the letter was issued without deciding on objections and without issuing a notification.
The petitioners have said that the move of the NGPDA is to facilitate certain individuals and to fool the people of Candolim and Calangute.
The government had passed the order in December, just before the Assembly elections but it has not been notified till date. Further, the government did not inform the High Court about the notification, in its affidavit filed in the petition filed by Calangute panchayat challenging the draft ODP, the petitioners said.
After hearing the advocate for the petitioners, the high court issued the notice and scheduled a hearing next week.
The high court has framed two issues for consideration: whether in view of section 238 and 239 of the Goa Panchayat Raj Act 1994 as well as Article 243 G of the Constitution of India, a planning authority can prepare a development plan and whether government can put in to operation a draft ODP pending finalisation.
The High Court observed that the petitioners can place their objections in connection to the draft ODP before the NGPDA and issued notice to parties and fixed the petition next week.
