PANJIM: Goa Congress President Girish Chodankar has approached the Supreme Court with an application stating that the registry has not listed his petition related to the disqualification of ten Congress MLAs who defected to the BJP last year.

In an application filed last Friday, Chodankar said that his petition was listed 18 times in the tentative work-list that is issued by the Court registry from time-to-time, but never made it to the final listing of cases.

The application noted that the matter was reflected in the tentative list for hearing once in August, five times in September, seven in October and on four occasions in November.

Chodankar said that his advocate-on-record (AOR) reached out to registry officials, through applications and emails, 12 times for the listing of his case.

“Despite his ‘relentless and unceasing effort,’ the only response the lawyer got was that his request was under consideration with the listing department that lists cases for hearings,” the application stated.

Chodankar has once again pleaded for early hearing in the disqualification petition. 

The Supreme Court through an order on August 11 had granted two weeks time to the Goa Speaker to submit an additional affidavit in the matter, after he had cited COVID-19 situation for the delay.

Chodankar had maintained that the MLAs have incurred disqualification under Article 191(2) of the Constitution read with para 2 of the Tenth Schedule and are liable to be disqualified as MLAs.
