Builder fined Rs 1 L for RERA violation

Section 3 of the RERA Act states that prior registration of the project is mandatory before promoter can advertise.

PANJIM: The Goa Real Estate Regulations Authority (RERA) has fined the promoter of  a project, Rs 1 lakh, for violating provisions of the Act. 

RERA had in July issued show cause notices to the builder for ten projects.

During the hearing, it was noticed that six of the ten projects were completed prior to November 2017 that is before RERA rules came into being and the completion certificates of all these projects were already issued. 

In case of rest of the four projects, the respondent informed that he wasn’t into marketing or issuing ads in respect of the project. 

The complainant Kashinath Shetye pointed out anomaly of marketing in respect of the project at Bambolim only. 

RERA also observed certain discrepancies as far as registration of the project was concerned. 

“Hence invoking Section 59(1) of RERA Act, a penalty of Rs 1 lakh (double the amount of project fee) is levied on the promoter of the project for violating provisions of Section 3 of the RERA Act,” the order issued by Sudhir Mahajan reads. 

Section 3 of the RERA Act and rules states that prior registration of the project is mandatory before promoter can advertise, market, book, sell or invite persons to purchase any apartments or plots.
