GSPCB directed to inspect alleged illegal constructions put up at Candolim beach

High Court orders to initiate action if premises are used for commercial operations without obtaining consent to operate; inspection to be carried out before April 16

PANJIM: The High Court of Bombay at Goa has directed the Goa State Pollution Control Board (GSPCB) to inspect the construction put up by three persons at Candolim and to initiate action against them as per the law if these premises are used for commercial operations without obtaining consent to operate.One of the premises were used for operating Droplet beach night club.

The Court also issued notices to six other respondents including the North Goa Planning and Development Authority (NGPDA), Candolim Village Panchayat, GSPCB, Raffle Square Development Pvt Ltd, Zulekha Ifran Tinwala and M/s Ekana Hospitality (Candolim) Pvt Ltd, while hearing a PIL writ petition filed by Calangute Constituency Forum through its president Premanand Diukar.

Arguing on behalf of the petitioner, Adv Rohit Bras de Sa and Adv Joel Pinto told the Court that Raffle Square Development Pvt Ltd, Zulekha Ifran Tinwala and M/s Ekana Hospitality (Candolim) Pvt Ltd, were carrying out commercial activities through constructions which had already been ordered to be demolished while, notices had been issued for violating the terms of the licence. 

The Court asked the GSPCB to inspect the constructions put up by the three respondents and in case any commercial operations were undertaken without consent to operate, then, to take action as was required under the law. The inspection should be carried out before the next date of hearing fixed on April 16.
