HC directs developer to deposit Rs 7.50 lakh for restoration of electricity connection

PANJIM: The High Court of Bombay at Goa has asked a developer to deposit Rs 7.50 lakh to restore electricity connection, which was disconnected due to seepage in the property situated at Anjuna.

M/s Vianaar Facilities Pvt Ltd had filed a writ petition stating that the disconnecting electricity supply to La Zamora and La Risa residential complex was arbitrary, illegal and also excessively disproportionate to the alleged violations thereby causing hardships to the residents of both the complexes. 

Representing the petitioner, Adv Varun Bhadanker said that electricity supply was disconnected on Thursday, despite an appeal pending. There are 32 units in both the residential complexes.

On December 12, 2023 the health officer primary health centre, Siolim had issued a notice to the petitioner directing him to stop the purported seepage from the retaining wall within seven days. Again in January 10, 2024, a show cause notice was notice to the petitioner for failing to take corrective measures to stop the seepage even as the petitioner relied that he had complied with the repair and maintenance and requested another joint inspection.

On January 31, the health officer issued disconnection order citing alleged nuisance in the residential complex.

But the deputy director (public) health of Directorate of health services set aside    disconnection order pending verification. In May again, the health office issued disconnection of electricity and water supply to the complexes.

The Court directed the petitioner to deposit  Rs 7.50 lakh with this Court within one week after which the health officer will immediately instruct the Electricity Department, Division VI, Mapusa, to restore the electricity. 

The petitioner has been directed to ensure that the Sewage Treatment Plant (STP) would be commissioned within a period of next six weeks to rectify the issue of seepage.
