HC stays MPDA functioning

VASCO: The Division Bench of the Bombay High Court at Goa has granted interim relief to the petitioner in the case challenging the appointment of Chief Town Planner Rajesh Naik as the Chairperson of the Mormugao Planning and Development Authority (MPDA). 

The court has ordered the MPDA not to operate until there is a board and an authority in place. This development has also sent all the decisions taken by the MPDA till now for a toss making them near illegal. Hearings will be held further on the legality of the decisions taken by the present MPDA. 

Giving interim relief to the petitioner, the Court said that until the court decides on the case, the present MPDA, which is without a board, can’t operate. 

Presently the MPDA doesn’t have a constituted board. The previous board term ended in March 2017 and they were operating without a board and only with a Member Secretary. In January 2018, Town Planner Rajesh Naik was appointed as the chairman but there was no board committee, which is mandated according to rules. 

The petitioner Edwin Mascarenhas from Vasco said that all the decisions that have been taken by the chairman and member secretary without a board now are illegal and the hearing on the same is yet to take place in the court.
