Directs State to file affidavit by Sept 18 on space for circuit bench; Asks if 500km to Pune is not convenient, how 1500 to Delhi will be?
PANJIM: The High Court of Bombay at Goa on Tuesday stressed upon setting up a circuit bench of the National Green Tribunal (NGT) in Goa.
It also advised litigants, lawyers and the government to find an amicable solution to the transfer of Goa cases from the Pune bench of the NGT to the New Delhi Principal Bench, stating that access to justice should be at the doorstep, while asking when 500 kms to Pune is not convenient, how can 1500 kms to Delhi be feasible and convenient?
The court was hearing the petitioners on the cases who said that a circuit bench of NGT may be set up in the old Session Court in Panjim. The court then sought a detailed affidavit from the State government on the space for such a bench by September 18 and has scheduled the next hearing on September 25 when it will pronounce its order.
The court will also pass an order on September 25 in the suo motu case challenging the notification issued by MoEF&CC (Ministry of Environment, Forest & Climate Control) over shifting of Goa cases.
MoEF&CC, in its submission to the HC through an affidavit, said the notification was issued based on the request of the Goa government.
The HC also extended its interim order that no files related to Goa cases will be transferred to Delhi till further orders.
The HC, taking suo motu cognisance of media reports over the shifting of the cases to Delhi from Pune NGT’s bench, had stayed shifting of Goa case files to Delhi till further orders. It had taken into consideration the volume of cases pending before the bench and inconvenience to the petitioners.
