Lawyer seeks transfer of Serula cheating case

PANJIM: As the Mapusa Judicial Magistrate First Class (JMFC) is vacant since December 2018, Adv Aires Rodrigues has moved the North Goa Principal District & Sessions Judge seeking to transfer the Serula Comunidade cheating case to another court for speedy trial. 

Rodrigues petitioned the court that the case involving former tourism minister Dilip Parulekar and others was filed in 2013 but the Court handling the trial has been vacant since December last year after the transfer of then Mapusa JMFC Shantashri Kudchadkar to Pernem JMFC. 

The Court has issued notices to Parulekar and the two other accused directing them to appear on April 5.

The petitioner drew the attention that the case after having travelled through various courts was finally by an order passed by the Bombay High Court at Goa on 22, 2018 sent to the JMFC, Mapusa. He further stated that proceedings commenced and matter was heard till December 1, 2018 after which the Judge was transferred to Pernem and the Court has remained vacant till date.

High Court Justice C V Bhadang had directed Parulekar and the other two accused Peter Martins, then attorney of Comunidade of Serula and Irene Sequeira, then Administrator of Comunidade of Bardez  to face  trial for offences under Sections 119, 120, 420 read with 120-B of the Indian Penal Code.
