CEO clarifies social media posts about ‘Tender’ and ‘Challenge’ vote

PANJIM: The Chief Electoral Officer (CEO) on Thursday said that a voter is entitled to cast a ‘tender vote’ if he or she finds out that someone has already cast a vote in their name. Tender votes are cast on ballot papers that are then sealed and locked away.

Also, CEO informed that “challenged vote’ means identity of voter is challenged, wherein if he or she fails to prove it, the voter is handed over to the police. 

The clarification from CEO was issued after social media was abuzz with the messages that under section 49A, a voter, whose name is not on the voter list can ‘challenge vote’ and ‘tender vote’. The messages also said that if any polling booth records more than 14 percent tender votes, re-polling is conducted in such polling booths. 

Responding to these messages, CEO IAS Kunal said that ‘tendered vote’ means voting by a person in ballot paper if his vote has been casted by another person after necessary enquiry by presiding officer. 

A tendered ballot paper, as per Rule 49P of the Conduct of Elections Rules, is given to that voter and they will be required to sign their name on the list of tendered votes.

A tendered ballot paper is the same as the ballot paper displayed on the balloting unit, except that it shall be endorsed on the back with the words, “Tendered Ballot Paper” either stamped by the returning officer or written by the presiding officer at the time of issuing it.

Further, in case their identity as a voter is challenged by a polling agent of any candidate on the grounds that they are not the person whose name is listed on the rolls, the presiding officer will ask the challenger to provide evidence in proof of his claim. 

“The identity is challenged by polling agent by depositing Rs2. In that case, presiding officer, ahs to do enquiry and if challenge is not established, voter is allowed to vote otherwise handed over to the police,” Kunal said.
