PANJIM: The National Green Tribunal (NGT), Western Zone Bench, Pune has asked the Goa Coastal Zone Management Authority (GCZMA) to give an opportunity of hearing to Jose Ivo Gregorio Barreto and others, who had prayed for deletion of their land from the draft GCZMA 2021.  

Jose Ivo Gregorio Barreto and others had approached the NGT seeking directions to the GCZMA to give a personal hearing to them in the matter and that the property admeasuring 10,390 square metres in Survey number 110/1 of the Morombi-O-Pequeno village in Merces, Tiswadi, be deleted from the draft GCZMP, 2021.

The applicants stated that there were owners in possession of the property and came to know that the above property has been categorised as partly khazan land, partly mangroves and partly as CRZ-I area, and included in the draft GCZMP in July 2021.

While disposing of application, the NGT asked the applicants to make a representation to the GCZMA within seven days and the GCZMA will decide the same in accordance with rules, within next one month.

The applicants had filed their objections before the Member Secretary of GCZMA, to the inclusion of the property in the GCZMP but the inclusion was carried out arbitrary without giving opportunity of hearing them.

The applicant’s father late Milagres Jose Santan Barreto had obtained a Conversion Sanad dated April 11, 1979 for a part of property admeasuring 4000 square metres for construction of a residential building and that user of the land was allowed to be changed from agricultural land to building and erection of a hotel. But construction did not commence due to objections raised by the Additional Collector as well as the Chief Town Planner. Later, the Revenue Secretary revoked conservation by an order dated February 12, 1981, which was challenged before the High Court of Bombay at Goa, who quashed and set aside the order of the Revenue Secretary.
