SC to hear tomorrow pleas for probe in judge B H Loya’s death

NEW DELHI: The Supreme Court on Thursday agreed for an urgent hearing on Friday to a Maharashtra journalist’s petition for an independent probe into the mysterious death of CBI judge Brijgopal Harkishan Loya, who was hearing Gujarat’s Sohrabuddin Sheikh fake encounter case of 2005 in Mumbai, in which BJP President Amit Shah was also an accused.

A Bench of Chief Justice Dipak Misra and Justices A.M. Khanwilkar and D.Y. Chandrachud took note of the submissions for the urgent hearing to probe the circumstances surrounding Loya’s death. He had died on December 1, 2014, in Nagpur where he had gone to attend the wedding of a colleague’s daughter.

Bhartiya Janata Party President Amit Shah was also an accused in the fake encounter case he was hearing. A new judge appointed after his death discharged Shah as an accused on the ground that there was no evidence against him. Shah was minister of state for home in the Modi government in Gujarat at the time of the encounter.

Journalist B.R. Lone petitioned to the Supreme Court, praying for a fair probe into the death of Loya in the light of two reports published in the Delhi-based Caravan magazine quoting immediate members of Loya’s family question the circumstances surrounding his death. 

Only three days ago on January 9, the Bombay Lawyers Association had also filed a PIL in the Bombay High Court, seeking a probe into Loya’s death and pointing out a high-profile case of Gujarat he was handling at the time of his death.

A total of 23 accused, including police personnel, are facing trial for their involvement in the alleged fake encounter of Sohrabuddin Sheikh, his wife Kausar Bi and their associate Tulsidas Prajapati in Gujarat in November 2005.
