
The Delhi Police on Monday invoked criminal conspiracy charges against two men arrested in connection with the recent alleged attack on Chief Minister Rekha Gupta.
A senior police officer confirmed that the new charges were added after investigators gathered evidence suggesting the assault was not a standalone act but part of a larger conspiracy.
The accused, Rajeshbhai Khimji and Tahseen Syed, who are currently in custody, were earlier booked under assault and related provisions. With the fresh development, they now face charges under Section 61 of the Bharatiya Nyaya Sanhita (BNS).
As per Section 61 of the BNS, an agreement between two or more persons to commit an illegal act—or to carry out a legal act by illegal means—constitutes criminal conspiracy. The law further stipulates that conspirators involved in offences punishable with life imprisonment or rigorous imprisonment of two years or more will be liable to the same punishment as if they had directly abetted the offence.
Police said further investigation is underway to determine the extent of the conspiracy and whether more individuals were involved.
