Justice Abhay Oka Calls for Judicial Resilience Amid Growing Criticism of Indian Judiciary

As the Indian judiciary faces increased scrutiny, particularly following reports of cash found at the residence of Justice Yashwant Varma, Supreme Court Judge Abhay S. Oka highlighted the importance of judicial resilience and maturity in handling criticism. Speaking at an event organized by the Supreme Court Advocates-on-Record Association (SCAORA) to commemorate 75 years of the Indian Constitution, Justice Oka stressed that the judiciary must not be overly sensitive to criticism, except when it amounts to contempt of court.

Justice Oka acknowledged the growing criticism of the judiciary in today’s media landscape, noting that while such scrutiny has always existed, it was once confined to the corridors of courts. With the rise of electronic and social media, criticism of the legal system is now amplified and heard "clearly and loudly." He emphasized that the judiciary must take this criticism in stride, using it as an opportunity for introspection and self-improvement.

"We should use it to find out if we have gone wrong somewhere and take corrective measures," said Justice Oka. He argued that while the judiciary must remain open to criticism, it should only become sensitive when the criticism crosses the line into serious contempt.

In his address, Justice Oka called for the judiciary to reflect on its flaws and deficiencies and use external criticism as a tool to address the issues facing the Indian legal system. He urged that while criticism is an inevitable part of the judicial process, it should be viewed as an opportunity for growth rather than a source of contention.
