SC Clears Road for E20 Petrol, Rejects Plea for Ethanol-Free Fuel

The Supreme Court on Monday refused to interfere with the nationwide rollout of 20% Ethanol Blended Petrol (E20), dismissing a plea that sought the continued availability of ethanol-free fuel.

A bench headed by Chief Justice B.R. Gavai and Justice K. Vinod Chandran rejected the petition filed by advocate Akshay Malhotra, who argued that vehicles manufactured before April 2023 — and even some BS-VI compliant models — were not compatible with E20 fuel. He cited a 2021 NITI Aayog report that warned of risks such as engine damage, reduced fuel efficiency, and higher maintenance costs. The petition also alleged that insurance companies might deny claims linked to ethanol-related damages.

The plea demanded ethanol-free petrol at fuel stations nationwide and mandatory labeling of ethanol content at pumps.

Attorney General R. Venkataramani opposed the petition, contending that the programme had been thoroughly debated before implementation. He said the policy benefits sugarcane farmers, reduces crude oil imports, and strengthens India’s energy security, while accusing the petitioner of fronting for vested interests.

Upholding the government’s stance, the apex court cleared the way for E20 adoption as part of India’s transition towards cleaner fuels and sustainable energy solutions.
