Calangute Illegal Construction: Goa High Court Directs Authorities to Inspect Sealed Umtawaddo Property

Acting on a complaint regarding alleged illegal construction at a sealed property in Umtawaddo, Calangute — which allegedly functioned earlier as a dance bar — the High Court of Bombay at Goa on Tuesday directed State authorities to inspect the site and submit a report at the next hearing.

The complaint was filed through a miscellaneous civil application by former Calangute panchayat member Sudesh Mayekar and Kundan Kerkar, who alleged that one of the respondents, Nasim Parves Jaffrani, had interfered with the sealed premises and carried out demolition work while keeping the front portion intact. According to the petition, Jaffrani subsequently reconstructed the structure without obtaining a de-sealing order from the High Court.

It was further alleged that the respondent left the sealed entrance untouched in order to “divert attention and presume that the structure is sealed”, while construction continued behind it.

The premises in question are among 13 properties previously ordered to be sealed by the High Court for lacking occupancy certificates and consent to operate from the Goa State Pollution Control Board (GSPCB).

The petitioners submitted photographic evidence of ongoing construction at the site.

Although several parties had obtained a stay from the Additional Director of Panchayats, Panjim, and were carrying out commercial activities in the sealed premises, the Court had made its position clear. In its January 10, 2024 order, it ruled that “only after all permissions from all authorities including but not restricted to consent to operate from the GSPCB and the occupancy certificate from the village panchayat, the parties would not be entitled to occupy the premises or carry out any activities therefrom.”

“Nasim Parves Jaffrani has not been issued any kind of licence whatsoever in respect of the establishment by the name and style of M/s Mehfil Bar and Restaurant running in survey number 177/8 at Umtawaddo, Calangute. In spite of premises sealed by the GSPCB, he commenced demolition of the illegal structure,” petitioner’s counsel Adv Rohit Bras de Sa told the Court.

Mayekar stated that the Calangute panchayat had also issued a stop-work notice to Jaffrani, warning him of necessary action if the illegal construction did not cease immediately.

On August 18, 2025, the Calangute panchayat conducted a panchanama at the site, which revealed that new construction was underway in survey number 177/8 using signboards, laterite stone, cement, steel, and aggregate.

The inspection team found that while the main door and a small portion of the structure remained sealed, a significant part of the property had been demolished and was under reconstruction.

As the respondent lacked valid permissions from the competent authorities, the panchayat once again directed an immediate halt to the construction.
