PANJIM: The legal opinion given by the lawyers to the reply filed by M/s Parmesh Construction Company Limited or Bhutani Infra project to the show cause notice will be the deliberated during the special meeting of the Sancoale village panchayat at 11 am on Tuesday, November 12.
During its fortnightly meeting on October 18, the panchayat had decided to seek legal opinion on the Bhutani Infra’s reply to the show cause notice even as it was opposed by the opposition panchayat members and villagers, who had gathered there.
The meeting had witnessed heated arguments between ruling and opposition panchayat members over the issue of quorum and the decision to seek legal opinion. The villagers were also demanding that the panchayat should withdraw the construction licence issued to the Bhutani Infra and scrape the controversial project proposed at Savorfond, Sancoale.
For Tuesday’s special meeting, only two points have been listed in the agenda. They are discussion on the construction licence issued to M/s Parmesh Construction Company Limited and to decide on work orders/supply orders to be issued for development works.
The meeting had decided to seek legal opinion on grounds that the reply to show cause notice was lengthy and filled with legal jargon, and the language used in the reply was complicated making it difficult to comprehend. The panchayat had given seven days to the project proponent to file its reply to the show cause notice.
But the opposition members and the villagers had demanded that the panchayat should revoke Bhutani Infra’s construction licence immediately since it had not obtained all the required permissions/clearances from the competent authorities.
The Bhutani Infra had so far obtained development permission and construction licence and had applied for permissions for cutting of land as mandated under Section 17 A of Town and Country Planning (TCP) Act and to the PWD for water connection.
The application for cutting of land was submitted on January 5, 2024 and for water connection on April 12, 2024.Also data collection is under preparation to seek Environment Clearance (EC), the company has stated in the reply.
The Bhutani Infra was granted development permission by the Mormugao Planning and Development Authority (MPDA) on February 2, 2024 while, Sancoale village panchayat issued construction licence on March 11 this year. Similarly, Goa Real Estate Regulatory Authority (RERA) has granted registration under the Real Estate Development and Regulatory Authority, on March 22 this year.
Meanwhile, ahead of the special panchayat meeting, a delegation of Goa Bachao Abhiyan (GBA) on Monday submitted a letter to the Director of Panchayats Siddhi Halarnekar and urged her to revoke the construction licence given to M’s Pramesh Constructions Company Ltd, by the Sancoale village panchayat.
The GBA stated that the gram sevak Orville C Vales, who is officiating panchayat secretary had signed the construction licence which is against the rules. The application for construction licence of Parmesh Construction Company Limited was inwarded and placed and passed at the panchayat meeting on the same day on March 11, without site inspection
While, no procedures were followed such as site inspection after permission was placed at the meeting. Also the resolution was not confirmed at next panchayat meeting, the GBA stated in its letter.
