The Green Goa Foundation has served a legal notice on the Chief Secretary to forthwith cancel, revoke and withdraw the license issued to Ms Orange Fish Entertainment Pvt Ltd to organize the Goa Fest on the public beach at Cavelossim from April 8-10.
The city-based NGO through its lawyer Adv S Kothare has threatened to file a contempt and other proceedings against the Chief Secretary and other authorities before the Panjim bench of the Bombay High Court if the license is not revoked forthwith.
The NGO has further called on the Colva police inspector and the Superintendent of Police, Margao to forthwith enforce rule 5(2) of the Noise Pollution (Regulation & Control) Rules in case the festival is allowed to be held, despite the legal notice, failing which the NGO said it will be compelled to institute proceedings against the police department for failure to enforce the law.
Saying that an organization calling itself AAAI Goa Fest Creative Awards Festival from Mumbai had applied for and has been granted license to perform a music and dance festival at the Mobor public beach by the Directorate of Tourism, the Green Goa Foundation claimed that the permission granted by the Tourism department to erect huge structure occupying over 2000 square meters of the public beach at Cavelossim is against public interest and all rules and regulations governing such permission.
The NGO stated that the setting up of a huge structure on the beach is in utter contempt of several writ petitions and judgments of the high court, adding that the public beach ought to be kept open to the public at all time and the government is not empowered to put restrictions on the use of the beach by the public.
