Duo convicted for using non-standard measures

Sanguem Judicial Magistrate First Class Sudhir S Shirgaonkar convicted Shailesh Parkar and Narayan Parkar for offence punishable under Section 34 of Standard of Weights and Measures (Enforcement) Act 1985 and sentenced the accused to pay a fine of Rs 1,000 each.
The incident occurred in December 2005 after the inspector of Legal Metrology Department, Sanguem, visited the bar and restaurant run by the duo at Sanguem bus stand.
On their visit to the bar and restaurant, the Director asked the duo to produce relevant registration documents and also standard peg measures for inspection. However, the accused failed to produce registration documents. Moreover, the inspector found that the measures used by the accused in serving liquor to the customers were not standard.
The inspector conducted the panchanama besides seizing the non-standard peg measures used by the accused.
The inspector also issued a memorandum to the accused, directing the duo to pay the fine of Rs 750, which the accused refused to accept and pay fine thereof.
Thereafter, a complaint was filed before Sanguem JMFC Sudhir Shirgaonkar who after going through the evidence led by the Prosecution and the arguments advanced by APP Govind S Gaonkar convicted the duo with fine of Rs 1,000 each.
Incidentally, this is one of the rare cases in which accused persons under Metrology cases stands convicted.
