Intervention plea in FIR against  10 MLAs to be heard on Aug 18

PANJIM: The judicial magistrate first class (JMFC), Panjim on Monday posted the intervention application filed by one Sushant Ray to the criminal miscellaneous application by Congress president Girish Chodankar seeking directions to the Panjim police to register FIR against 10 party rebel MLAs and others for forging documents, to August 18.

When the matter came up for hearing before the JMFC, Ray filed an intervention application praying that he be allowed to participate in the case and to direct and to permit him to advance oral/written arguments in the matter. 

Ray brought to the notice of the JMFC that he had also filed similar applications before the Goa Assembly Speaker who was hearing two disqualification petitions against 12 MLAs for defecting to other political party and also before the Supreme Court.

Ray told the court that as intervenor he will facilitate the adjudication of the present proceedings since there is a high probability of the State/respondents or the applicant suppressing the crucial facts from the court for ‘obvious reasons’ due to ensuing Assembly elections.

Arguing on behalf of Chodankar, Adv Abhijit Gosavi told the court that he was not going into the merit of the intervention application and argued that the application is not legally permissible at the pre-cognisance stage and is liable to be dismissed. He also cited ruling by the High Court in such cases.

After hearing both the parties, the JMFC kept the intervention application for orders on August 18. On the same day, the court allowed the petitioner to argue in the main matter ie to the reply filed by the Panjim police station.

During the last hearing, the Panjim police had filed its reply stating that the complaint has been forwarded to the Porvorim police station on point of jurisdiction, for necessary action.
