PANJIM: The Goa Human Rights Commission (GHRC) has ruled a decision in favour of the Industrial Development Corporation (IDC) at Tuem Industrial Estate regarding a complaint of construction of a “pucca stone wall” in a property connecting a locality to the main road from Tuem to Mapusa.
A group of villagers had in December 2017 complained to the Commission that the construction of a wall in property bearing Survey No. 24/0 was violating their human rights. The complainants alleged that IDC constructed a “pucca stone wall” in the said property where there was an old existing motorable access connecting the main PWD road.

The construction, they alleged, blocked the entry of the people to the motorable access resulting in human rights violation.
The IDC, on the other hand, submitted to the GHRC that after acquiring the property, the compound wall and gates were constructed to safeguard and protect the interests of parties who are running the industries. One of these gates to the compound wall touches the boundary of the Survey No. 24/0.
Following detailed hearing during the last over three years, the Commission of Chairperson Justice U V Bakre and Members Desmond D’Costa and Pramod Kamat, ruled that no human rights of the complainants have been violated.
“From the averments made in the complaint, it is evident that the complainants are seeking enforcement of their easementary right through the properties of the Respondent (IDC). Due to the construction of the compound wall with gates by the Respondent around their properties, for security reasons, it cannot be said that any human rights of the complainants had been violated,” the Bench observed.
The remedy, the GHRC said, for the complainants is to approach the Civil Court and not the Commission.
