The Ministry of Environment and Forests on Monday came out with the checklist before undertaking projects attracting the Coastal Regulation Zone Notification, 1991.
It says prior clearance is to be obtained for the projects listed in the CRZ Notification as amended from time-to-time and fall within the approved Coastal Zone Management Plan (CZMP) of the respective State/Union territory.
The following check-list will be referred to when any proposal for such clearance is considered by all State/Union territory Coastal Zone Management Authorities and should be enclosed when the recommendations of these authorities are sent to the ministry or the State Government, says a notification on the ministry website.
1. Application by project proponent
(i) Has the map been prepared by anyone of the authorised agencies as per the guidelines issued by Ministry of Environment and Forests vide letter No.J-17011/8/92, dated December 29, 1999 for demarcating High Tide Line and Low Tide Line in 1:4000 scale (cadastral scale map)?

(ii) Has the CRZ area been demarcated on the above map (i) above, in accordance with the CRZ Notification, 1991 and the approved CZMP?
YES/NO
(iii) Has the project layout been superimposed on the above CRZ map (ii) above?
YES/NO
(iv) Has the CZMA clearly rejected OR recommended the project to the concerned Authorities i.e., to the State Government or to MoEF in accordance to the CRZ Notification?
YES/NO
(v) Has the CZMA while recommending the project categorically indicated the correctness of the CRZ map submitted by the proponent to the CZMA?
YES/NO
2. Examination by State/Union Territory Coastal Zone Management Authority
(i) Has the Coastal Zone Management Authority (CZMA) examined the project in accordance to the CRZ Notification, 1991 and the approved CZMP?
YES/NO
(ii) In case there is a deviation of the newly demarcated High Tide Line/Low Tide Line with respect to the approved CZMP, has the CZMA submitted the map to National Coastal Zone Management Authority for reclassification? (Until such time the reclassification is not done the project cannot be considered under the CRZ Notification).

(iii) In case of construction (new/reconstruction/expansion of existing authorized buildings) projects falling in Coastal Regulation Zone-II, each of the following conditions shall need to be considered separately:
a) Is the proposed construction on the landward side of an authorized road (as existed on 19.2.1991) and or authorised structure (as existed on 19.2.1991)

(b) Is the CRZ-II area within the territorial jurisdiction of the Municipal limits as it existed on 19.2.1991 i.e., the date of coming into effect of the CRZ Notification, 1991?

(c) Is the construction/protrusion towards the seaward side going beyond the imaginary line drawn from the seaward side of the existing authorised structure on the adjoining plot?
YES/NO
(d) Is the imaginary line parallel to the High Tide Line?
YES/NO
(iv) Are the building(s) to be constructed restricted to the single plot boundary (as on 19.2.1991) immediately abutting the existing authorised structures between which the imaginary line is drawn?
YES/NO
(v) Does the imaginary line to be drawn cut across any river, creek, backwater, sandy beach or mangroves?
YES/NO
(vi) Is the Floor Space Index/Floor Area Ratio for such projects in the CRZ areas as existed on 19.2.1991 as per the local Town and Country Planning?
YES/NO
Note:- For the projects that attracts Environmental Impact Assessment (EIA) Notification, 2006 and CRZ Notification, 1991, the following shall be done:-
(i) The proposal shall satisfy the check-list above under 1(i) to (iii) 2(i) to (vi).
(ii) After obtaining the recommendations of the concerned Coastal Zone Management Authority, Environmental Clearance under EIA Notification, 2006 shall be obtained from State Environmental Impact Assessment Authority/State Environmental Appraisal Committees or Environmental Appraisal Committee/Ministry of Environment and Forests, as the case may be.”
