which had rejected the application of the 85 room hotel project proposed in the village on various issues including the lack of an eight meter wide road at the site.
While the villagers has vowed to fight the order once they receive the copy, Curtorim panchayat officials stated that they have not received a copy of the order as yet but would act accordingly
Parsekar passed the order suspending the gram sabha resolution on grounds that the gram sabha has no powers to issue construction license
It maybe recalled that the Curtorim panchyat on November 2014 had issued a notice on Ms ira Exotica Pvt Ltd to show cause why the construction license isssued for the hotel project should not be kept in abeyance in view of the gram sabha resolution.
MS Ira Exotica had later challenged the panchayat’s show cause notice.
before the additional panchayat direction on grounds that matters concerning construction activities does not fall within the purview of Section 6 of the Goa Panchayat Raj Act, while terming the gram sabha resolution as totally illegal and unlawful.
The gram sabha resolution had rejected the proposal on the grounds that it does not have the mandatory eight meter road access and the adjacent land owners are not willing to part with their land. Activist Abhijit Prabhudesai who has been at the forefront of the agitation felt the pancahat should have sent a notice to the hotel owner about the road leading to the panchayat site instead of citing the gram sabha resolution.
The gram sabha resolution had also rejected the proposal stating that no multi housing hotel, row house or other large projects will be allowed in Curtorim as the village does not have land for rural housing for the poorer section and future generations, that Curtorim is endowed with steep hill slppes, agricultural lands, lakes and fields and that these eco sensitive lands have to be preserved for the future generation and that the village does not have garbage, sewage , roads , electricity water and other infrastructure for large projects.
