His petition is listed before the Bench of Justices Fakkir Mohd Kalifulla and Shiva Kirthi Singh on Monday.
Pacheco, who is a Goa Vikas Party MLA, has been dodging the jail term since he was sentenced to undergo six months of imprisonment in October 2011. On March 30, the Supreme Court had dismissed his earlier petition and he has been in hiding since then.
