One convicted for theft

Quepem Judicial Magistrate First Class Sayonara Telles e Laad convicted one Parshuram Upaste of Bijapur-Karnataka for effecting entry into an anganwadi room and a storeroom of Government Primary School at Gavwaddo-Xelvona and committed theft of articles worth Rs 8,000.
Upaste effected entry into the anganwadi room and the storeroom of GPS in the intervening night of July 25, 2009 and July 26, 2009, by break opening the wooden plank of the door leading to anganwadi room and the store room and committed theft of daily use utensils like steel plates, steel glasses, steel spoons and other articles worth Rs 8,000.
The prosecution led by APP Satyavan Raut Dessai examined seven witnesses in the matter including Investigating Officer Mohan Fadnis.
After going through the evidence led by the prosecution and arguments advanced by APP Satyavan Raut Dessai, Judge Sayanora Telles Laad held the accused guilty of offence and accordingly convicted the accused for eight months rigorous imprisonment and a fine of Rs 1,000 for offence under Section 475 and for an equal term for offence under Section 360 of IPC. Both the sentences are to run concurrently.
Further, the Judge in her order observed that as the accused is in the custody since the time of his arrest, the period of his being in custody after the commissioning of the offence is to be set-off from the period of sentence. The amount if recovered from the accused is to be paid to the complainant.
