“The perusal of the entire material collected by the investigating agency reveals that there is reasonably strong suspicion against the applicant and therefore, there is prima facie evidence against him in respect of the offence punishable under Section 302 of IPC. The learned sessions judge has rightly dismissed the application for bail and for discharge filed by the applicant,” says the order by Justice U V Bakre while rejecting the application.
“Considering the nature of the offence and the nature of evidence collected by the investigating officer and the apprehension of the Investigating Officer that the applicant may threaten the witnesses and may tamper with the evidence, I am not inclined to grant bail to the applicant. Hence, the application stands rejected,” Justice Bakre ruled.
Arun Bras de Sa and Pandurang Shirodkar were advocates for the applicant while Joseph Vaz was Special Public Prosecutor for the CBI.
The CBI were asked to investigate the case and a new case was registered for offence under sections 120-B and 302 of IPC on February 18, 2014 against the applicant. Investigation had revealed that the applicant used to torture his wife, both mentally and physically, by way of dowry harassment, since their marriage in 1996 and this harassment ultimately culminated in her murder, sometime in December 2010. The applicant was arrested on April 23, 2014 and charge sheet was filed by compiling the outcome of both the said cases, since the documents and the witnesses were common in both the cases..
