MARGAO: In an interesting development, the High Court has declined to issue directions to the Margao Municipality to make the bio-metric finger scan machine functional, but has directed the Chief Officer to call a meeting with the municipal employees and seek their comments on the matter.
The High Court, however, said there cannot be any manner of doubts if the bio-metric finger scan machine which has been installed in the civic body is made operational, saying it will definitely ensure the attendance of the employees.
Saying that the entire problem can be solved once the municipal employees give their willingness to use the bio-metric system, a two-judge Bench comprising of Justice V M Kanade and Justice U V Bakre, however, said it is open for the Chief Officer to take further steps, if the employees do not accept his reasonable suggestions.
Though the Bench observed there is substance in the submission made by the learned counsel appearing for the petitioner Green Goa Foundation, the Court, however, declined to exercise writ jurisdiction under Article 226 of the Constitution of India, saying it is not fit and proper to give directions to the Chief Officer to make the bio-metric system functional, since it falls within the realm of administrative action which has to be taken by the Chief Officer.
Green Goa Foundation in its writ petition contented that if the bio-metric system is made functional, it will ensure accountability of the employees.
