PANJIM: The High Court of Bombay at Goa on Monday dismissed the plea filed by activist Kashinath Shetye to register a criminal complaint against two former ministers. Shetye had appealed in the HC seeking that it direct the police to register an FIR against Churchill Alemao and Aleixo Sequeira for holding dual citizenship, however, the court dismissed the appeal stating that the competent authority has not declared them foreigners.
Shetye had filed a police complaint against Alemao and Sequeira in 2014 at Colva and Maina Curtorim Police Station seeking that the police register an offence and investigate the case under relevant sections of the Indian Penal Code as they being of Indian origin allegedly held dual citizenship.
After police failed to register the offence, Shetye had approached a Margao Court but the court had passed an order stating the offence cannot be registered in view of lack of evidence against the two.
Shetye had then challenged the order in the HC.
Shetye said he will now approach the Supreme Court challenging the High Court order. He said the competent authority order doesn’t come in the picture as far as criminal cases are concerned.
