MARGAO: After withdrawing his anticipatory bail application, Colva panch Calvert Gonsalves on Tuesday moved an application to surrender himself before the court. The complainant, however, has taken strong objection to the application on the basis of technical points, and the hearing on the same is scheduled for Wednesday.
It may be recalled that fellow Colva panch Francisco Cardozo filed a complaint at the Colva police station alleging that Gonsalves, at a panchayat meeting on August 29, repeatedly made filthy, derogatory and casteist remarks and threatened him. Accordingly, an offence was registered against Gonsalves under Section 3 (X) of SC/ST Prevention of Atrocities Act, 1989 and Section 504 of IPC.
On Tuesday, Cardozo filed an intervention application claiming that this matter is out of the jurisdiction of the court and has to be dealt with by the special court. He also objected to the surrender application on grounds that the accused has to be present while filing the application. The proceedings were held at the Court of Judicial Magistrate First Class (JMFC) Vijayalaxmi Priolkar.
South Goa Principal District and Sessions Judge Nutan Sardessai, on Monday, dismissed as withdrawn the anticipatory bail application filed by Gonsalves. The order on his application was to be pronounced the same day.
Cardozo, represented by Adv Aires Rodrigues, had also filed an intervention application strongly opposing the anticipatory bail application filed by Gonsalves
. Adv Rodrigues drew Judge Sardessai’s attention that Section 18 of the SC/ST Act barred any anticipatory bail from being granted.
