MARGAO: JMFC Carlo Santana da Silva on Tuesday discharged the case filed by Margao Town Police against Francis Pereira for desecrating the Krishna Temple at Calcondem and ordered that he be released from the jail for this particular case.

Francis’ advocate Eric Coutinho had pointed out to the court that besides the confessional statement there was no evidence to prove that Francisco had desecrated the Tulsi and Nandi statue at the temple

on the intervening night of July 3 and 4.

He argued that a confessional statement made while in custody of the police is not admissible as evidence. The Judge holding that there was no evidence against Francis, discharged the case against him and also directed that he be released from jail for this particular case.

This is the fifth case in Margao courts that Francis has been discharged.
