Karnataka told not to divert water without permission from all authorities
Furthermore, the Tribunal has passed an injunction against the state of Karnataka from diverting any water without taking necessary permission from all concerned authorities.
“The tribunal has also directed Karnataka not to go ahead with the project unless Karnataka prepares a modified Detailed Project Planning (DPR) for the same. Interim order dated 17-04 -2015 is continued till the State of Karnataka takes all necessary permissions from all the authorities and their projects are approved by authorities concerned,” Additional Solicitor General Nadkarni informed.
The tribunal in its order has categorically said that the Order of injunction passed by the tribunal dated 17.04.2014 filed by the State of Goa will continue to be operative and stand vacated revoked only after the state of Karnataka prepares revised DPR for consumptive uses within the basin and/ or diversion of water outside the basin including the reservoir losses etc. for not more than 1.72 TMC at the proposed Kalasa dam site as permitted under Clause IX .Karnataka is also expected to submit the revised DPR of Diversion Scheme at Kalasa Dam site duly appraised and cleared by the Central Agencies such as the Mahadayi Water Management Authority or the Union Government.
“For the diversion of water for the Mahadayi hydro electric power project at Kali (5.527 tmc ) and Kotni reservoir (7 TMC) the Tribunal has found that the claims of the State of Karnataka is not justified and rejected,” Nadkarni added.
Maharashtra granted 1.33 TMC water
Outside the basin diversion at Tillari rejected
As regards the state of Maharashtra is concerned, out of the total demand for 7 TMC of water, they have been granted only 1.33 TMC of water i.e only for in basin use.
As far as Tillari outside the basin diversion is concerned, the same has been rejected by the Tribunal. Furthermore, the contention of the State of Maharashtra that 10 TMC of the Tillari project should also be included in the yield of the Mahadayi basin, the said contention has been rejected.
