CBI probe into Vasco minor rape case flawed: Victim’s advocate

Says suspect caught by a teacher not paraded before witnesses; CBI failed to investigate events immediately after the crime

VASCO: The advocate for the father of Vasco minor rape victim has submitted to the court that the investigation conducted by the Central Bureau of Investigation (CBI) was flawed.
When the case came up for hearing on Thursday before Vasco JMFC Apurva Nagvenkar, Advocate Fr Michael Fernandes representing the victim’s father filed his written submission objecting to the CBI plea to close the case.
The hearing was slated for arguments on Thursday, but due to time constraint, Fr Fernandes filed his written submission objecting to the CBI plea to close the case. In his written submission, Fr Fernandes has pointed out certain flaws in the investigation conducted by the CBI.  
Later, the hearing was adjourned to November 2 when the CBI is expected file their reply to the submissions of Fr Fernandes.
Fr Fernandes told Herald that he has submitted before the JMFC that the CBI failed to conduct a thorough investigation into the case. “We have also contended that on the day of the incident, a suspect was caught in the staircase by a teacher who brought him to the headmistress, but that suspected person was not physically paraded before the witnesses, which is a lapse on the part of CBI,” Fr Fernandes added.         
He pointed out that the crime was committed at 10.30 am, but the victim’s father was informed of the same much later and that he reached only at 1 am. In fact, the police was already present in the school when the victim’s father reached. Therefore, the CBI should have brought on record what transpired between 10.30 am and 1 pm, he said.
“Similarly, we have also submitted that though CBI should have investigated the case from scratch, but it continued with the investigation relying on the investigation done by other investigating agencies,” he said.
