Sanguem Judicial Magistrate First Class (JMFC) Artikumari Naik has convicted Luis D’Costa and Benny Azavedo, both residents of Collem, of assaulting the linesmen, Ballappa Yelvi and Gangaram Patel, while on duty.
The offence of assault on the duo was filed at Collem Police station by Junior Engineer, attached to Electricity Department, Curchorem, Jaipal Bidrali. The case was investigated and charge sheeted by Investigating Officer Jaidev Gawas. Both the accused persons were charged under Section 332 read with 34 IPC.
On the day of the alleged offence which took place on July 7, 2007, linesmen Bellappa Yelvi and Gangaram Patel had gone to the village to undertake repair work of the main electricity line, when an altercation broke between the linesmen and the accused. The accused allegedly assaulted the linesmen with slaps.
Immediately, a complaint was lodged and the accused were arrested by police and later released on bail.
The Court after going through the evidence led by the Prosecution and on hearing the arguments led by the APP Govind Gaokar convicted the duo and sentenced the accused to pay a fine of Rs 3,000 each.
Incidentally, the accused persons aggrieved with the Judgement passed by the JMFC and are likely to file an appeal before the District and Sessions Court against the order of conviction passed by the JMFC Sanguem.
