Cops scan coastal belt for Mickky

MARGAO, JUNE 13 The police continued their hunt for the former tourism minister, Mickky Pacheco along Salcete's coastal belt, even as all eyes are focused on the bail plea hearing of Pacheco's OSD Lyndon Monteiro scheduled to come up for hearing in the High Court on Monday.

The police continued their hunt for the former tourism minister, Mickky Pacheco along Salcete’s coastal belt, even as all eyes are focused on the bail plea hearing of Pacheco’s OSD Lyndon Monteiro scheduled to come up for hearing in the High Court on Monday.
It is not known whether the beleaguered Benaulim MLA would surrender to the Crime branch on Monday or wait for the High Court to pronounce its order in Lyndon’s appeal filed against the order of the South Goa Sessions Court rejecting the bail application.
Even as the former minister continues to elude the investigating agency, the Colva police along with sleuths of the Crime Branch continued to search for the MLA, especially along the coastal belt.
Like during the last two days, the police also visited Betalbatim, Majorda and Colva as part of efforts to lay their hands on the elusive MLA.
A police officer attached to the Colva police station informed that the search exercise is apparently to send a signal to the former minister to come out from hiding and surrender to the investigating agency.
It is learnt that Pacheco think tank are consulting legal experts and are drawing up strategies following the rejection of his bail application by the South Goa Sessions Court last week.
Meanwhile, the Crime Branch has said that its scientific investigations of call details of mobile phone of Nadai Torrado shows that the deceased was using mobile No 9011077725, which was in her name, and had made calls to Pacheco on his mobile phones 9822126126 and 9822125999 on May 13, 14 and 15, ie the day of the incident when the deceased consumed the Ratol.
LYNDON BAIL PLEA: The anticipatory bail application filed by Lyndon Monteiro, OSD to former tourism minister Mickky Pacheco will come up for hearing before Justice U D Salvi of the Bombay High Court at Goa on Monday. 
An anticipatory bail application can be filed under Section 438 of the Criminal Procedure Code only by the person anticipating arrest. But sources said in Lyndon’s case the application before the High Court has been filed by his mother, which is not in accordance with the court rules. On this technical ground itself the application may be dismissed outright, they said.
Sources further revealed that Lyndon’s anticipatory bail application has been styled as an application under Section 439 of Criminal Procedure Code. As an application under Section 439 is by someone already in custody it can be moved by a family or friend on behalf of the accused, they stated.
