FIR against CM, two others

PANJIM: The Judicial Magistrate First Class at Mapusa DM Kerkar has ordered the Police Inspector of Calangute police station to file a First Information Report (FIR) within 24 hours against the jailor, the inspector general of prisons and the home minister and investigate the death of prisoner Mahadev Gaonkar, who lost his life in the recent food poisoning case at Aguada jail.

PANJIM: The Judicial Magistrate First Class at Mapusa DM Kerkar has ordered the Police Inspector of Calangute police station to file a First Information Report (FIR) within 24 hours against the jailor, the inspector general of prisons and the home minister and investigate the death of prisoner Mahadev Gaonkar, who lost his life in the recent food poisoning case at Aguada jail. 
The order passed on January 30, asks the PI to file a report before this court within three days of the order. 
“I am of the considered opinion to direct the Police Inspector, Calangute police station forthwith to register within 24 hours an FIR and investigate the death of prisoner Mahadev Gaonkar which is caused due to the negligent act by the jailor, IG Prisons (North Goa Collector Mihir Vardhan) and the Home Minister (Chief Minister Manohar Parrikar) who have due to their deliberate negligent act caused the death of the prisoner Mahadev Gaonkar by not creating good facilities of mess/canteen and have created harmful atmosphere to the health prisoners (sic),” the order reads. 
“I hereby direct the Police Inspector Calangute Police station forthwith register within 24 hours an FIR and investigate into the matter under section 269 (Negligent act likely to spread infection of disease dangerous to life), 270 (Malignant act likely to spread infection of disease dangerous to life), 271 (Disobedience to quarantine rule), 304A (causing death by negligence), 120 B (Punishment of criminal conspiracy) and 34 (criminal acts done by several persons in furtherance of common intention) of the

Indian Penal code and file a detailed report before this court within three days of this order,” the order reads. 
It may be recalled, a prisoner, Mahadev Gaonkar, died and 100-odd others were taken ill on May 31 last after they suffered food poisoning at the Central Jail and also at a sub-jail in Mapusa.
In another order issued on the same day by the same Judge, DM Kerkar has directed the Police Inspector Paresh Naik, DySP Serafin Dias, SP (North) Priyanka Kashyap to investigate the organizers of the India Bike Week, officials of the Anjuna comunidade and the Anjuna panchayat. 
All respondents (police officials mentioned above) are directed to investigate into the matter and investigate all persons against whom suspicion is raised and to do a proper investigation. 
The violation, the judge said “was the sound of bikes roaring up and down and also the noise pollution within the jurisdiction of Vagator area.”
THE JMFC ORDER
