Flat owner seeks govt compensation

PANJIM: The High Court of Bombay at Goa on Monday issued a pre-admission notice to Goa government on a petition filed by an aggrieved flat owner seeking compensation on the demolition of a two-storey building one week after the Ruby Residency tragedy in January 2014.

After the collapse of the under-construction building at Chaudi, Canacona that killed 31 labourers and injured many others, then chief minister Manohar Parrikar had observed cracks on the adjacent building. The government had demolished the structure a week later fearing a similar collapse.
Anupama Jai Shankar, one of the flat owners, has now approached the High Court seeking compensation while contending in her petition that her flat was neither faulty nor endangered anyone’s life.
However, a minor portion of her flat was damaged as the debris of the collapsed structure had fallen on it. She pointed out that when rescue operations were underway at the incident site, Parrikar visited the spot and asked for the demolition of the adjacent building in which she owned a flat.
She has pleaded to the court to direct the government to pay her compensation as her right to have shelter was violated.
During a brief argument, the State counsel submitted that the builder should be liable to pay compensation rather than the government.
The High Court later issued pre-admission notice to the government and directed it to file a reply by November 23.
