PANJIM: Licences of liquor shops will not be renewed if they are located within prohibited areas such as educational institutions or religious institutions, according to a notification issued by government.
No licences will be granted to anyone if the liquor shop which he/she proposes to open is located within a prohibited area. This applies to retail sale of liquor in sealed bottles.
Section 90, 4) (a) of the Goa, Daman and Diu Excise Duty Rules, 1964 states “No licence shall be granted to an applicant if the premises in which he proposes to open liquor shop are within a radius of 100 meters from (an educational institution or a place of worship)…. No licence shall be granted to an applicant if the premises in which he proposes to open liquor shop is within a radius of 100 meters from a Harijan Basti or a Labour Colony.” These are prohibited areas under the Act.
The government has amended the Goa, Daman and Diu Excise Duty Rules, 1964 stating that in Rule 90 of the Goa, Daman and Diu Excise Duty Rules, 1964,in sub-rule (4), after clause (d), the following clause shall be inserted, namely: ~ “(e) (i) No licence shall be granted to an applicant for retail sale of liquor in sealed bottles, if the premises in which he proposes to open liquor shop is located within the limits of the prohibited area.
(ii) No renewal of licence shall be granted to an applicant who is holding such licence for retail sale of liquor in sealed bottles, if his liquor shop is located within the limits of the prohibited area. Prohibited area means an area other than that of Defence Establishment, where direct entry to any person is prohibited or restricted due to security reasons or otherwise,” says the notification issued by Under Secretary, Finance Ajit S Pawaskar.
