MARGAO: Margao Judicial Magistrate First Class Reina Fernandes on Friday allowed the intervention application filed by Colva Panch Francisco Cardozo seeking to intervene in the bail application filed by absconding Colva Panch Calvert Gonsalves.
Defending Calvert Fernandes, Adv Rajeev Gomes prayed that the arguments on the maintainability of the case be heard and order pronounced first, as the same could contradict with the order on Calvert’s surrender application.
Adv Aires Rodrigues representing Francisco Cardozo and Assistant Public Prosecutor Jyotin Thakkar strongly opposed the bail application. However, Adv Rajiv Gomes objected to the bail hearing on the ground that the JMFC lacked jurisdiction.
Meanwhile, the judge adjourned further arguments on the maintainability of bail application filed by Calvert Gonsalves, to Monday, while the order on the bail application would be delivered on December 1.
The case pertains to a complaint filed by Francisco Cardozo at the Colva Police Station against Calvert for allegedly making filthy, derogatory and casteist remarks repeatedly against Cardozo. Calvert also allegedly threatened Cardozo with dire consequences. The case was later registered under Prevention of Atrocities against SC and ST’s Act.
Earlier this week, Calvert had withdrawn his anticipatory bail application filed before the Sessions Court and filed an application for surrender.
Meanwhile, all eyes are on the Colva Panchayat meeting on Saturday. If Calvert fails to attend tomorrow’s meeting he stands to be disqualified as a panch since he has already missed two meetings.
, earlier. The defence however claims that they would file a proper reply to the panchayat stating the reasons, if at all Calvert stays absent.
