PANJIM: The North Goa Planning and Development Authority (NGPDA) has directed demolition of illegal construction built along the Atmaram Borkar Road, Panjim, within one-month from the issuance of the order failing which the Authority shall demolish the said illegal structure and recover the cost of the demolition from the violators.
The NGPDA passed the order following directions by the High Court of Bombay at Goa seeking to initiate action against the said construction and carrying out joint site inspection, while hearing a writ petition filed by Rasiklal Gangani of Panjim. The High Court had also observed that no part of deviation which is otherwise a major deviation including the encroachment on public road, be condoned by the NGPDA.
The NGPDA has rejected the Revised Plan dated March 28, 2022 submitted by Narendra Shah and others as the said deviations are beyond the scope of relaxation of the Authority as per the Regulation 3.8 of the Goa Land Development and Building Construction Regulations, 20 10. Shah and others had submitted an application for Revised Plan for reconstruction of the existing building with change in use, internal alteration and addition in the said property.
But the NGPDA rejected the Revised Plan on account of below observations: The entire existing structure/house (G+1) have been demolished wherein as per the approved plan the covered area of the existing house was proposed for demolition is 6.25 square metres
The new construction carried out on site is RCC structure by erecting columns, casting beams and slabs which is totally in violation and deviating the plan approved dated October 6, 2021 of GPPDA which was issued for internal alteration within the existing building by removal of internal wall and intermediate floor and without demolishing the outer wall and façade existing
The demolition carried out of entire existing structure/house (G+1) is evident from the photographs placed on record by the complainant Rasiklal Gangani.
Rule 6.A.B table (VII) and parking provision as per table (IX-A) as per the provision of Goa Land Development and Building Construction Regulations-2010 in force as applicable for new construction is now applicable in this case with respect to requirement of coverage, setbacks and parking provision.
The Revised Plan dated March 28, 2022 submitted is in violation as coverage exceeds maximum permissible 50%; front setback towards the road are not maintained and parking provision for a vehicle as per requirement is not provided.
The NGPDA has also refused to consider the structural audit of the existing house carried by the structural engineer as a proof for structural stability of existing structure for unsafe of existing house as the same was not brought to the notice of this Authority before carrying out demolition of the existing house or before commencement of construction work.
It may be noted that the inspection by the Corporation of City of Panaji (CCP) and the Town and Country Planning (TCP) Department had found that while undertaking construction, Shah and others had not maintained the required setback from the centre of the main road, wherein minimum distance required to be maintained from the centre of road was 13.5 metres.
