Pereira’s lawyer questions arrest move, objects to intervention

With Malcolm Agnelo Pereira seeking protection from arrest in the Chinchinim-Deussa sar panch assault case, his law yer Adv Amey Prabudessai on Thursday questioned the need for further police action after Pereira had complied with a notice issued to him under Sec tion 35(3) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), while also object ing to Gomes’ intervention in Pereira’s anticipatory bail plea. Pereira had appeared before the Cuncolim Police on Wednesday in response to the notice issued under Section 35(3) of the BNSS.

The notice required him to remain present at the po lice station and cooperate with the investigation. Prabudessai, speaking to the media after the hear ing, said the defence had received the notice and had appeared before the police in compliance with it. He said the defence had there after approached the court with the anticipatory bail application in view of the apprehension of arrest. The defence also objected to Gomes being permitted to intervene in the anticipa tory bail proceedings. The court, however, allowed the intervention application and heard the intervenor. Prabudessai said the an ticipatory bail application was argued before the court on Thursday. The police opposed the application, while the Public Prosecu tor also made submissions against the grant of bail. The defence’s position centred on the circum stances in which Pereira had been called by the po lice and his subsequent ap pearance before the inves tigating team.

Prabudessai indicated that Pereira had complied with the police di rection and that the defence was questioning the basis for treating arrest as neces sary after that compliance. The intervention applica tion filed by Gomes was also contested by the defence. Gomes sought to place ad ditional material before the court as the complainant in the case, but Prabudessai maintained the defence’s objection to his participa tion in the bail proceedings. Prabudessai said the ar guments had been complet ed after the court allowed the intervention applica tion. He said the defence had placed its case before the court and that the police had strongly opposed the grant of anticipatory bail. The lawyer said the pro ceedings before the court had concluded for the day after all sides made their submissions.
