PERNEM: It has been almost six months since the poor widow Priya Mitybowkar has been begging for justice but the police will do anything to prove that the high and mighty politician and his son are ‘innocent’ and deny her justice.
Priya’s husband Nilesh Mitybowkar committed suicide in November last. After Pernem police failed to file an FIR in the complaint against Water Resources Minister Dayanand Mandrekar, and his son Samir, she approached the JMFC Pernem under Section 156/3 of CrPC for justice.
Shockingly, the Pernem police in a reply to the court in the abetment to suicide case against the Mandrekars, have said that Nilesh had committed suicide due to depression primarily on account of his loan dues.
In her application, Priya stated, “Samir along with his father Dayanand had been harassing, torturing and pressuring my late husband with the sole intention to evict him and his family from the tenanted property to the extent that he could not take it any further and committed suicide.”
For almost two months the Pernem police did not file a reply in the court and on March 30, it says there was no evidence to prove charges against the Mandrekars.
“At the outset the respondent submits that the petition under reply does not curl out or even prima facie establish any offences under the sections against Dayanand Mandrekar and Samir and therefore the petition needs to be dismissed,” the reply states.
The reply further states that the Pernem police inspector had visited the house of the applicant after her husband had committed suicide by hanging on 26/11/2015 and a statement was recorded on 7/12/2015 in which she said that she did not suspect any foul play and had committed suicide due to hanging.
“It has further come on record that applicants close relatives Shyam Mitybowkar and Ankush Mitybowkar have stated the deceased was under depression primarily on account of his loan dues. Another relative Suraj Morajkar in his statement said that he did not suspect any foul play,” the Pernem police reply through their counsel Special Public Prosecutor G D Kirtani states.
The police further claims that Priya, except for filing a complaint on 10/12/2015 has not placed any material evidence as regards her allegations against the Mandrekars.
Further, about the property rights, the reply states, “It is confirmed that the name of the applicant and/or her husband has not been appearing even in the other rights column of the original survey no 182/4. It transpires that the applicant’s late husband had put up some construction in the property pursuant to which a complaint was filed by Samir Mandrekar to the concerned authorities and a FIR was also registered under Section 447/427 of IPC against the applicant’s late husband. It transpires that the GCZMA passed order against the said illegal structure after issuing a show cause notice and in pursuance of the same, the said illegal structure was demolished,” the police reply said.
Further, it says, “Since the allegations by applicant have not been substantiated by adequate legal evidence the applicant’s complaint for registering an FIR could not be adhered to. The statements and documents produced suggest that the matter is more of a civil dispute.”
