The City Fast Track Court on Friday dismissed the petition filed by the State Government against Adv Aires Rodrigues in connection with the 2004 Ribandar Church case.
The petition was filed by the government against the order of Chief Judicial Magistrate (CJM) P M Shinde directing that further proceedings be stopped against Adv Rodrigues in the second charge sheet filed against him in connection with 2004 Ribandar Church incident.
Dismissing the petition the Additional Sessions Judge Vijaya D Pol stated that Adv Rodrigues was rightly discharged by the CJM, Panjim.
The CJM in its order on December 22 last year observed that he could not be tried twice for the same incident or on the same facts as it was barred by section 300 of the CrPc.
Shinde in his order had also stated that there was lack of ingredients in the offences alleged against Adv Rodrigues in the charge sheet filed by the police.
Along with Adv Aires Rodrigues, 14 other Ribandar residents had been charge sheeted in the case including an 80-year-old widow who is now bedridden.
Earlier, JMFC Panjim Sharmila Patil had on April 9, 2009 acquitted Adv Rodrigues in another case filed by the police against him regarding the same Ribandar Church incident.
