PANJIM: Revenue Department has asked the Office of the Administrator of Comunidades and the Collectorate to follow a uniform procedure in allotment of comunidade land by auction. The instruction comes after the department observed ‘scant attention’ in scrutinising such cases.
“It has been observed that scant attention is paid by the Office of the Administrator of Comunidade and the Collectorate in scrutinising the cases of allotment of comunidade land with auction. The uniform procedure needs to be followed in the case of allotment of comunidade land by auction by all Administrators of Comunidades,” reads the order.
The fresh circular has listed 13 points that need to be followed during the process such as mandatory enclosures of Form I & XIV, site plan, survey plan, residential certificate, valid NOC from Town & Country Planning Department, etc along with deposit of Rs 2500 as process expenses.
“Whenever the comunidade deliberates and decides on granting of land on emphyteusis, sale or exchange, under Article 30, the minutes of such deliberations along with the proposed plan for development of the particular area after following the restrictions as provided under Article 325 to 328 shall be forwarded to the Government through Director of Civil Administration/Collector for its approval as required under Article 31,” the order states.
The bidder participating for the auction should take necessary enquiry report from the concerned comunidade three days before the auction.
, it further states, instructing that request of the applicant should be published in two continuous Gazettes and two newspapers.
calling for objections for which the time limit is 30 days.
“When no objection is received, the administrator should forward the application to the comunidade concerned for their consent. If an objection is received then it is the duty of the administrator to examine the objection and pass an order with reasons either sustaining the objection or overruling the objection,” it adds.
The site inspection on fulfillment of the requirements, giving an auction notice of 15 days, depositing of one year’s lease in the event of an applicant winning the bid and applications to be put up for approval of the special committee are amongst other procedures laid down in the fresh circular.
