Revised land development and building construction regulation notified

This was part of the ease in business initiative being promoted by the Govt of India

PANJIM: Department of Town and Country Planning (TCP) has notified the revised Goa Land Development and Building Construction Regulations, with a focus on ease of doing business. The new regulations have for the first time taken into account comprehensive regulations for shopping malls cum multiplexes. 
The main revisions proposed include a provision for third party certification by notary architects and notary engineers for facilitating issuances of technical clearance/development permission/completion order by Town and Country Planning Department and Planning and Development Authorities for low-risk category buildings.
These provisions have been introduced as part of the Ease of Doing Business being promoted by Government of India. 
The revised guidelines, kept open for suggestions from the public before January 25, 2019, has envisaged issuance of technical clearances/development permission, etc by the department and Planning and Development Authorities (PDAs) for low-risk category buildings without site inspection. For this purpose, the low-risk category building include ground plus two storey building up to 500 sq mtrs built up areas in plot area limited to 500 sq mtrs in an approved layout. 
The regulations has given exemption from obtaining technical clearance for operational constructions up to 200 square metres per Mega Watt for solar farms as envisaged in the Goa State Solar Policy 2017.
The proposed revision also covers substantive provisions for newly designated professionals like Diploma Engineers/Supervisors (Civil).
A comprehensive regulations for shopping mall cum multiplex have been prescribed which was absent in the present Regulations taking into account the present day requirements, for such constructions.
There are provisions to exclude Engineer and other professionals employed with the government departments and government undertakings having required qualifications from registration with Chief Town Planner for signing building plans of Government projects.
The proposed revision has provisions to exclude Architects from registration under the Regulations as Architects registered with Council of Architects do not need to get registered under the regulation, Architects Act provide for it.
There is relaxation applicable to SPC (Special Commercial Zone) is proposed to be made applicable in the C1 special zone also.
The provision is also there for appointment of Supervisor for building projects having more than 1000 square metres built up area and for high rise buildings irrespective of built up area.
