PANJIM: Members of the recently elected Managing Committee of the Comunidade of Serula demanded that they be administered the oath of office immediately, now that the Administrative Tribunal has dismissed the election petition filed against them.
It may be recalled that on September 25, Judge Raikar of the Administrative Tribunal dismissed the election petition filed against the elections held on 20.01.13 by Cezar Pinto, a Gaunkar of Serula, without nullifying the same.
In a memorandum submitted to the Administrator Irene Sequeira, members of the Managing Committee elect under President Elect Antonio Lobo said that since the Administrator was a party to the petition, she is now duty bound to comply with the provisions of the Code of Comunidades that deals with the constitution of the new effective Managing Committee.
The newly elected Managing Committee comprises of President Antonio Lobo, Substitute President Melchier J Pinto do Rosario, Attorney Eurico Mascarenhas, Substitute Attorney, Edgar Frias Pinto, Treasurer Norman Albuquerque and Substitute Treasurer Cyriacus Agnelo Sanches.
The members pointed out to the Administrator that already a lot of time has been lost, since charge has not been handed over to them, despite they being elected subject to duly conducted elections.
Speaking to the media the members also alleged that on account of their not being given oath of office and charge of running the Comunidade, a lot of illegalities have taken place at the behest of the temporary committee which does not have the mandate to take any major decisions and said that the Administrator will be held personally responsible for any loss caused to them.
The members of the committee have warned the Administrator that if she does not comply by installing them in office as per law with immediate effect in accordance with Article 125 (2) and Article 30 r/w section 31 of the Code of Comunidades, they will not hesitate to initiate legal action against her in the appropriate court of law.
