Special Court to hear Monserrate case after HC verdict

MAPUSA: The designated Special Court, Mapusa on Monday said that the proceedings against MLA Atanasio (Babush) Monserrate, his wife Revenue Minister Jennifer and others in the 2008 Panjim police station attack case, will be taken up only after the High Court of Bombay at Goa gives its verdict on the plea for quashing of criminal proceedings filed by the Monserrates and some of the other accused. 

Barring Babush Monserrate, Jennifer and some of the other accused, including former Panjim Mayor Tony Rodrigues, appeared before the Mapusa Additional Sessions Judge Sherin Paul, who heads the designated court to try criminal cases against politicians. MLA Monserrate, however, skipped the hearing.

The Special Court will now issue fresh notices to all the accused after the High Court gives its verdict on the plea for quashing of criminal proceedings filed by the Monserrates and some of the other accused.

Last week High Court Judge, Justice Manish Pitale, had concluded hearings in the case and had 

reserved his order on the petitions filed by the Monserrates and other accused seeking quashing of the proceedings in that case.

Meanwhile, Adv Aires Rodrigues stated that he would move an application to assist the prosecution in the criminal case to ensure that some of the accused do not manipulate the trial. He said that he had to approach the High Court to vacate the stay of the criminal trial granted by the High Court seven year ago.
