Two Panjim children move HC for contempt proceedings against CCP

Claim corporation failed to initiate action against illegal kiosks in Children’s Park

PANJIM: Two children from Panjim have approached the High Court of Bombay at Goa to prosecute the Corporation City of Panaji for contempt after it failed to initiate action against illegal kiosks in the Children’s Park.
The petitioners, both minors, have filed a Public Interest Litigation (PIL) before the HC claiming that CCP can be sued for contempt of court for violating the order.
The High Court through its order in 2008 had directed that “if any gaddas/handcarts are encroaching on the public roads, streets or footpaths, the corporation has to act in accordance with the law and take action within three months.”
Several kiosks in the State were removed after the High Court order, which had also ordered that the civic bodies form enforcement squads to clear all footpaths.
The petition says, “Till date, the enforcement squad has not conducted patrolling in the city regularly. Moreover, no action is being taken after receiving complaint from the residents about the encroachment, thereby contravening the High Court order.”
