Vagator’s noise polluter has no fear of law

Booked for playing loud music beyond stipulated hours; owner had not obtained Air and Water consent to play loud music

PANJIM: The shack that was booked for playing loud music beyond the stipulated time recently had skirted the legal requirement to obtain Air and Water Act consent from the Pollution Control Board. A recent inspection of the Goa State Pollution Control Board (GSPCB) revealed that the shack was functioning without  the consent to operate under Air (prevention and Control of Pollution) Act and Water (prevention and Control) Act Air from the Pollution Control  Board.  

On February 11, the GSPCB following a complaint inspected the shack for noise pollution violations and officials comprising of the Assistant Environment Engineer, Scientific Assistant and Senior Laboratory Assistant conducted the noise monitoring at M/s Glory, Small Vagator, Ozran Beach Road. There were allegations that the shack was playing loud music beyond 10 pm, violating the High Court order.

The GSPCB officials along with the complainant inspected the shack at 11 pm on February 11, and found that music was being played at the venue beyond 10 pm.

The noise monitoring was carried out outside the unit premises on the bench and the decible level was recorded as 87.1 dB(A) for the period from 11.21 pm to 11.51 pm. The inspection team informed the representative Rakesh Sharma, who was present at the venue, that playing of music is not permitted beyond 10 pm, states the GSPCB report.

It was also found that the M/s Glory had consent to operate till February 2, 2023 under the name M/s Chronicle (temporary shack). The said name has been changed to M/s Glory. Presently, the unit is operating without valid consent to operate under the Air Act and Water Act,” stated the findings of the report.

GSPCB Chairman Mahesh Patil said, “The Board will issue a show cause notice to the erring party and if found in violation, we will initiate appropriate action according to law.” 

Patil said that due to the `Ease of Doing Business’, several shack operators were taking permissions from the Department of Tourism for their shack and restaurants but do not take mandatory permissions from the GSPCB for operations.
