MAPUSA: The Goa Coastal Zone Management Authority (GCZMA) has issued a show cause notice-cum-stop work order to Waters Beach Lounge and Grill Private Limited, Vagator for carrying out an illegal construction of permanent structure in No Development Zone (NDZ).

The order has been issued under Section 5 of the Environment (Protection) Act, 1986, read with Rule 4 of the Environment (Protection) Rules, 1986.
The orders states that illegal construction of permanent structure of multiple floors with steel and cement, sand, motor and laterite stones by cutting hill, sand dunes have been destroyed and illegal construction of compound wall in Survey Nos 213/17 and 213/18 has been carried out in No Development Zone (NDZ).
The suo motu writ petition is filed before the High Court of Bombay at Goa by the complainant Surendra Govekar.
All proposed construction/re-construction/development/repair and other permissible activities between 100 metres from the river, and 500 metres of the sea require the prior approval of the GCZMA under the CRZ notification, 2011.
The said construction/activity appears to be without any prior approval of GCZMA as required under CRZ notification, 2011.The violator has been directed to stop work with immediate effect and has been asked to show cause as to why direction to demolish the structures and to restore the land to its original condition should not be issued.
Further, the violator is directed to ensure that no civil work of whatsoever kind and nature is carried out at the said site and has been asked to file reply along with compliance report and construction/reconstruction/repair licence/approvals, if any, issued by the authorities concerned including GCZMA along with approved plan within 15 days from receipt of the order.
The order further stated that if Samar Merchant fails to submit reply along with the required documents, the GCZMA will come to the conclusion that there is no justification to carry out activities and the authority shall proceed to issue final directions without any further notice which inter alia includes order of demolition of structures, disconnection of water/power supply etc.
